PHARMAC is seeking feedback from pharmaceutical suppliers and interested parties on: · · · A proposal to tender certain pharmaceuticals for sole supply; The draft process and terms and conditions for the Invitation to Tender 2009/10; and Commercial Proposals as an alternative to tendering.

All feedback received by the deadline may be considered by the Tender Medical Evaluation Subcommittee of PTAC, and will be considered by the PHARMAC Board (or Chief Executive acting under delegated authority) prior to making a decision on this proposal. Details of the proposed 2009/10 multi-product tender In general, the proposed Tender process would be similar to the 2008/09 Tender. In addition to Alternative Commercial Proposals that are discussed later, we seek comments on the approach outlined in the following pages, in particular on: · · · The proposed process; The proposed timetable; An indication of any pharmaceuticals, whether or not included in Schedule Two of the draft Invitation to Tender, that you think would be inappropriate to tender, and the reasons for that view; An indication of any pharmaceuticals, whether or not they are included in Schedule Two of the draft Invitation to Tender, that you consider should be tendered, and the reasons for that view. If you wish, you may provide a non-binding confidential

indication of the price or price range that you might be able to offer for a line item or group of line items you wish to have tendered; Any contractual constraints or patent protection that could restrict PHARMAC from awarding a Tender on a particular pharmaceutical; For Hospital pharmaceuticals, feedback on the appropriate Discretionary Variance Limit for each pharmaceutical, in the event that a 1% Discretionary Variance Limit is considered clinically unacceptable; and feedback on any unresolved Tender Bid(s) from previous tenders that you consider should remain open for acceptance.
We seek comments on all sections of the draft Invitation to Tender. The draft Invitation to Tender is based on the format of the Invitation to Tender dated 23 December 2008 for community supply and/or hospital supply. Alternative Commercial Proposals PHARMAC seeks any Alternative Commercial Proposals (ACPs) to tendering that you may wish to submit by 5pm, Friday 25 September 2009. An ACP, for example, may offer price reductions on one set of pharmaceuticals in return for PHARMAC agreeing to defer tendering on another group of pharmaceuticals for a period. Please note the following points with regard to ACPs for both the community and DHB Hospital markets: · · Proposals may include more than one line item and may include pharmaceuticals not listed in Schedule Two of the draft Invitation to Tender; Proposals may seek PHARMAC’s agreement to defer tendering or application of reference pricing as a result of a Tender award for a period of time for any pharmaceutical, whether or not it is listed in Schedule Two of the draft Invitation to Tender; Proposals must not involve PHARMAC agreeing to award Sole Subsidised Supply in the community but may include the awarding of Hospital Supply Status for DHB Hospital pharmaceuticals; PHARMAC reserves the right: o not to accept any proposal; and/or o not to provide reasons for the acceptance or non-acceptance of any proposal; and/or o to enter into an agreement or arrangement that differs in a material respect from that envisaged in this letter; and PHARMAC may decide not to consider any proposal that is submitted after Friday 25 September 2009.

Tender Timelines This year we are proposing to bring forward the tender timelines by one month, this would result in the final Invitation to Tender being released in late November, consequently the closing date for tender submissions would move forward to the last week of January. The proposed timeline is outlined in the following table:

Since inception, PHARMAC’s annual multi-product tender has generally been released at the end of December of each year with the closing date for tender submissions in late February or early March of the following year. Each year the Invitation to Tender includes a number of products coming off Sole Subsidised Supply at the end of June of the following year. Previous tender timelines have meant that April is the earliest month that the PHARMAC Board (or Chief Executive, under delegated authority) is able to make tender decisions that would involve a brand change. A number of suppliers have commented in the past that the existing timelines, on occasion, make it difficult for the incumbent (Sole Subsidised) supplier to manage its inventory while tender decisions are pending an announcement. PHARMAC considers that moving forward the tender timelines by one month in the 2009/10 Tender and by a further month for the 2010/11 Tender may help to alleviate a number of stock management issues that have previously been experienced by suppliers during the transition period of a brand switch. Should this proposal be implemented, suppliers could be notified as early as January of tender decisions from the 2010/11 Tender. Any feedback regarding the proposed tender timelines should be received by PHARMAC no later than 5pm, 2 October 2009. Draft Invitation to Tender PHARMAC seeks feedback on the terms and conditions of the draft Invitation to Tender to be considered by the PHARMAC Board at its November 2009 meeting. Attached is the draft list of products to be tendered (Schedule Two). A complete copy of the draft Invitation to Tender is available on our website (www.pharmac.govt.nz), including the terms of supply. PHARMAC proposes that, if a Tender Bid was accepted by the PHARMAC Board (or the Chief Executive under delegated authority), it would be subject to the terms and conditions of the draft Invitation to Tender. The draft Invitation to Tender is still under development and may change before it is taken to the Board for approval and subsequently issued. PHARMAC is seeking feedback on the composition of the draft Invitation. At this stage, but depending on the extent of any changes, PHARMAC does not intend to send out any further drafts for consultation. Any feedback regarding the draft Invitation should be received by PHARMAC no later than 5pm, 2 October 2009. Late feedback may not be considered. Consultation feedback received by the due date will be presented to the PHARMAC Board for consideration before it makes its decision. The draft Invitation to Tender comprises the following sections: Schedule 1: Schedule 2: Definitions and interpretation; The list of pharmaceuticals proposed to be tendered. Please note that the market data for the year ended 30 June 2009 provided in this Schedule has not yet been finalised; however finalised data would be captured in the final Invitation to Tender. The final list of pharmaceuticals would be released with the Invitation to Tender following Board approval (please note that the list may change following consultation, and that you may provide feedback on the inclusion of additional pharmaceuticals after the Invitation to Tender has been issued, and any such feedback would be considered by the Board (or Chief

Executive) before making a final decision on any Tender Bid provided that the feedback is given before the tender close date in early 2010); Tender process (for both hospital and community Tenders); Contract terms for Sole Subsidised Supply and/or Hospital Supply Status; Additional contract terms for Sole Subsidised Supply; Additional contract terms for Hospital Supply Status.
The main changes are: Audit PHARMAC proposes to amend clause 3 of Schedule 4 of the Invitation to Tender to include a provision that would provide an auditor authorised by PHARMAC, the access to the premises of any wholesaler or other distributors. Withdrawal or suspension of Sole Supply Status and/or Hospital Supply Status PHARMAC proposes to add a provision in clause 1.3 and clause 1.4 of Schedule 5; and clause 1.7 and clause 1.8 of Schedule 6 of the Invitation that would provide PHARMAC with the option to withdraw or suspend Sole Supply Status and/or Hospital Supply Status for other forms or strengths of the same chemical if PHARMAC has exercised its rights to withdraw or suspend Sole Supply Status under clause 1.3 or clause 1.4 of Schedule 5 and/or Hospital Supply Status under clause 1.7 and clause 1.8 of Schedule 6 of the Invitation to Tender. Price PHARMAC proposes to add a provision both in clause 3 of Schedule 5 and Schedule 6 of the Invitation to Tender that clarifies the expectation that the price offered by a supplier through the tender process would incorporate any costs incurred following the subsequent delisting of the product.
Electronic Tender (eTender) system The final 2009/10 Invitation to Tender will be distributed via the eTender system and a test of supplier’s email addresses will occur in November 2009. Please ensure that you respond by 5pm, 2 October 2009 with updated addresses if your email has changed. Unresolved Tender Bids PHARMAC would review any unresolved Tender Bids from the Invitation to Tender dated 21 December 2007 (2007/08 Tender) and the Invitation to Tender dated 23 December 2008 (2008/09 Tender) prior to issuing the 2009/10 Invitation to Tender. Should any unresolved Tender Bids be declined, PHARMAC would consider re-tendering those pharmaceuticals when the Invitation to Tender is issued in November 2009. Unresolved Tender Bids have not been included in the draft pharmaceutical list. PHARMAC seeks comments from suppliers that consider that any unresolved Tender Bid(s) should remain open for acceptance by 5pm, 2 October 2009.

Reference Pricing Reference pricing is based on the classification of pharmaceuticals into Therapeutic Subgroups. A Therapeutic Subgroup is defined as a set of pharmaceuticals that produce the same or similar therapeutic effect in treating the same or similar condition(s). The draft list contains pharmaceuticals that belong in an existing Therapeutic Subgroup. In some cases, PHARMAC may be considering tendering more than one pharmaceutical in a Therapeutic Subgroup. Where this is the case it gives rise to a number of scenarios including: 1) It is possible that awarding Sole Subsidised Supply to one pharmaceutical could result in changes to the subsidies for other pharmaceuticals in the same Therapeutic Subgroup; and/or 2) Where more than one pharmaceutical in a Therapeutic Subgroup is included on the list, PHARMAC may award Sole Subsidised Supply to each pharmaceutical (and therefore not apply reference pricing in the usual way) or may only award Sole Subsidised Supply to one pharmaceutical and apply reference pricing to the others. Such scenarios could give rise to new or increased manufacturer surcharges. We ask that you consider any clinical considerations associated with such scenarios. We note that funding of escitalopram, gemfibrozil, ketamine hydrochloride, pramipexole hydrochloride, rabeprazole, and sertraline have been considered by the Pharmacology and Therapeutic Advisory Committee (PTAC) or the relevant Subcommittee of PTAC; however further review, and the review of the remainder of the chemicals in the list above may be considered by PTAC and/or PTAC Subcommittee, after tender bids have been received. Please note the decision to fund the chemicals listed above would largely depend on the pricing of Tender Bids against that of alternative chemicals already listed on the Pharmaceutical Schedule. We note that PHARMAC would be willing to support priority assessment from Medsafe to applications submitted as a result of the tender process where we consider it to be appropriate.
