14 September 2007 TO: MEDICAL GROUPS, DHB HOSPITAL PHARMACIES AND INTERESTED PARTIES CONSULTATION ON TENDER OF CERTAIN PHARMACEUTICALS ALL RESPONSES DUE BY 5PM, 26 OCTOBER 2007 In accordance with PHARMAC’s objective of securing for eligible people in need of pharmaceuticals, the best health outcomes that are reasonably achievable from pharmaceutical treatment and from within the amount of funding provided, PHARMAC is consulting on the possibility of tendering for Sole Subsidised Supply and/or Hospital Supply Status of certain pharmaceuticals listed in Schedule One of this document. Attached to this letter is a list of pharmaceuticals that we are considering tendering for Sole Subsidised Supply to community pharmacies and/or Hospital Supply Status for supply to DHB Hospital pharmacies. Pharmaceuticals are listed alphabetically by chemical, form and strength in therapeutic groups and have a ‘C’ and/or ‘H’ next to them to indicate whether they are being tendered for community and/or hospital supply. In general, the proposed Tender process would be similar to the 2006/07 Tender. A copy of the 2006/07 Invitation to Tender is available either on our website: www.pharmac.govt.nz, or by contacting PHARMAC. Comments Sought We seek comments on the approach outlined in the following pages, in particular the following: · · · · the proposed process and timetable; the actual or potential clinical implications of awarding Sole Subsidised Supply and/or Hospital Supply Status to the pharmaceuticals listed in Schedule One; and for hospital pharmaceuticals what the appropriate Discretionary Variance Limit for each pharmaceutical would be, where a 1% Discretionary Variance Limit is considered clinically unacceptable; and comments on a proposal for Sole Subsidised Supply to include access to funding for alternative brands (Alternative Brand Access).

Background Since 1997 PHARMAC has been using the strategy of tendering for sole supply of pharmaceuticals for a fixed period of time. Tendering has proven to be an effective way to encourage competition among suppliers of off patent pharmaceuticals. It is proposed that the community Tender and hospital Tender processes continue to be run in unison, however the pharmaceutical list for community and hospital pharmacies may be different.

Key Aspects of Awarding a Tender for Community Pharmaceuticals: · For the community pharmaceuticals the Tender winning brand would be the only subsidised brand for approximately 2½ years. The Sole Subsidised Supply period would conclude on 30 June 2011 for all awarded Tenders. The Sole Subsidised Supply brand would be fully subsidised for the Tender period which means a pharmaceutical that currently carries a manufacturer’s surcharge (that is the additional patient charge above that of the patient copayment), would become fully subsidised if a Tender was awarded. No other brand of the pharmaceutical could be listed (or subsidised) on the Pharmaceutical Schedule during the Tender period (subject to any Alternative Brand Access, as proposed). Other brands could continue to be marketed, sold and dispensed in New Zealand, however they would not receive a Government subsidy.

·

·

·

Key Aspects of Awarding a Tender for the DHB Hospital Pharmaceuticals:

·

For the DHB Hospital pharmaceuticals, the Hospital Supply Status brand would be the only brand DHB Hospitals could purchase (excluding any allowance for alternative brands under the agreed Discretionary Variance Limits) for approximately 2½ years. The Hospital Supply Status period would conclude on 30 June 2011 for all awarded Tenders. No other brand of the pharmaceutical would be listed (or purchased) on Section H of the Pharmaceutical Schedule during the Tender period except as allowed under any DV Limits.

·

The Process The Tender process is run annually. The proposed timelines for the 2007/08 Tender are as follows:

Date September/October 2007 26 October 2007 November 2007 Late December 2007 Late February 2008 From April 2008 30 June 2011 Event Consultation with suppliers, medical groups and interested parties on the proposed pharmaceutical list and draft Invitation to Tender. Final date for all consultation to be received. Meeting of Tender Medical Evaluation Subcommittee of PTAC to consider clinical issues in relation to the proposed Tender list. Issuing of the 2006/07 Invitation to Tender. Invitation to Tender closes. Board decisions on the first Tender winners announced. End of the sole supply period for all pharmaceuticals where a Tender is awarded from the 2007/08 Tender. Terms after the End Date may apply.

Unresolved Tender Bids PHARMAC would review any unresolved Tender Bids from the Invitation to Tender dated 22 December 2005 (2005/06 Tender) and the Invitation to Tender dated 15 December 2006 (2006/07 Tender) prior to issuing the 2007/08 Tender. Should any unresolved Tender Bids be declined, PHARMAC would consider re-tendering those pharmaceuticals when the Invitation to Tender is issued in December 2007. Any unresolved Tender Bids have not been included in the draft pharmaceutical list.

Contractual obligations for suppliers A copy of the draft contractual requirements which would form the terms of the contract with successful suppliers in the 2007/08 Tender is available on the PHARMAC website: www.pharmac.govt.nz, or by phoning PHARMAC on 0800 66 00 50. The following proposed changes to the Invitation to Tender should be noted: This year PHARMAC proposes to introduce an electronic tendering system that suppliers would be required to use in order to submit a Tender Bid(s). Alternative Brand Access This year we are also consulting on adding an allowance within the Tender contract for PHARMAC to provide funding for alternative brands of community pharmaceuticals (called Alternative Brand Access). This is a change from previous years’ tenders, and if adopted would create a new mechanism for people to access brands of a medicine other than the one that wins the tender contract. If the contractual allowance for Alternative Brand Access is adopted it would necessarily result in some changes to the manner in which Sole Subsidised Supply operates. As well as comments on the proposal in general, we seek particular consideration of the following questions: · · Should we allow the provision of a subsidy for an alternative brand and, if so, in what circumstances? What percentage allowance for alternative brands should be included within tender bids?

Background Between 1997 and 2007 over $300 million that would otherwise have been unavailable has been reinvested in new pharmaceuticals and other health services as a result of sole-supply tenders. Tenders and RFPs encourage competition so that the value from pharmaceuticals is maximised (including the costs of continuous supply being underwritten). Sole Subsidised Supply for a defined period of time is often used to generate this competition. Once Sole Subsidised Supply is awarded all other brands of that pharmaceutical are delisted from the Pharmaceutical Schedule, and are no longer subsidised. It may be desirable, where identified as a need by PTAC (and/or relevant subcommittee), to have greater flexibility under the sole supply policy for people to access other brands when the tender-winning brand is clinically unsuitable. Alternative Brand Access recognises that while most generic products will have established “bioequivalence” to the current market leader, in some circumstances a small number of patients may experience difficulties with the change. Currently the mechanism available for funding of alternative brands, where one brand holds Sole Subsidised Supply, is through the Community Exceptional Circumstances (CEC) process. Given its specific criteria and purpose, the CEC process typically provides funding for alternative brands very infrequently.

A150080 - qA7633

3

Possible mechanism for implementation To enable the proposed tender contractual changes to be developed, PHARMAC has considered possible mechanisms to apply an Alternative Brand Access. We are proposing the following mechanism: · The product list would contain an Authorised Allowance which would be the amount of an Alternative Brand of a particular pharmaceutical that could be subsidised without reimbursement to the tender winner for the reduced volume. An allowance in the region of 0.2 - 1% may be appropriate (where applied at all), although we welcome other views. PHARMAC would seek advice from PTAC and/or its relevant subcommittee on whether to include an allowance in each case. The access to funding for the alternative brand would be through a Special Authority, on an “access by application” basis. Applications would be considered by a panel of practicing clinicians, using the following criteria, or similar:

Evidence is provided by the patient’s doctor that: a. The patient was adequately managed on a previously subsidised brand, and the subsidy for that brand is being removed as a result of Sole Subsidised Supply; and b. There are no other suitable alternative pharmaceuticals, or all the alternatives (including dose adjustment) have had an adequate trial and failed; and c. The Sole Subsidised Supply brand is considered to be unsuitable because of: i. A serious adverse reaction has occurred to the Sole Subsidised Supply brand ; or ii. An excipient in the Sole Subsidised contraindicated in the patient; or Supply brand that is

·

· ·

iii. Lack of efficacy or intolerable side effects to the Sole Subsidised Supply brand that persist through an adequate trial of the subsidised brand, followed by reappearance of the issue on re-challenge. Approvals would not be given for issues related to features of the product that were considered as part of the tender evaluation (e.g. physical features of the product such as flavour, coatings etc.), and would not be given if the issue arose more than 6 months after the initiation of the Sole Subsidised Supply period.

·

The funding for an alternative brand would be provided on a “Cost Brand Source” basis, meaning that funding could be provided even if the product had to be sourced from overseas (i.e. if the local supplier had discontinued supply).

Lead Time We propose to amend the Lead Time so that it is clear that the quoted Lead Time means that stock would be available to the market on the 12th prior the listing date in

A150080 - qA7633

4

the Pharmaceutical Schedule (see proposed definition of Lead Time in clause 1 of Schedule 1 of the Invitation). Financial compensation for breach of DV limits PHARMAC proposes to amend the minimum payment required of a DHB that breaches its DV limits, where the national DV limit has been breached, from $5,000 per tender item to $1,000 per tender item. Reference Pricing Reference pricing is based on the classification of pharmaceuticals into Therapeutic Subgroups. A Therapeutic Subgroup is defined as a set of pharmaceuticals that produce the same or similar therapeutic effect in treating the same or similar condition(s). The draft list contains pharmaceuticals that belong in an existing Therapeutic Subgroup. In some cases, PHARMAC may be considering tendering more than one pharmaceutical in a Therapeutic Subgroup. Where this is the case it gives rise to two possible scenarios where: 1) It is possible that awarding Sole Subsidised Supply to one pharmaceutical could result in changes to the subsidies for other pharmaceuticals in the same Therapeutic Subgroup. 2) Where more than one pharmaceutical in a Therapeutic Subgroup is included on the list, PHARMAC may award Sole Subsidised Supply to each pharmaceutical (and therefore not apply reference pricing in the usual way) or may only award Sole Subsidised Supply to one pharmaceutical and apply reference pricing to the others. Both scenarios could give rise to new or increased manufacturer surcharges. Distribution of Consultation Documents Please note that this consultation letter has been widely distributed however should you consider that a particular person, group or agency should receive this and future Tender documents please feel free to contact PHARMAC (also available from our website). We also invite any person or group to contact PHARMAC should you wish to have a meeting to discuss this consultation document. Please direct any queries you may have to Mike Bignall (DDI: (04) 9167 562) at PHARMAC for questions in relation to community supply, and Andrew Davies (DDI: (04) 9167 531) for questions in relation to hospital supply. Yours sincerely

Please note that pharmaceuticals with indications that may apply to multiple therapeutic groups will only appear in one.

Therapeutic Group Alimentary Tract and Metabolism Blood and Blood Forming Organs Cardiovascular System Dermatologicals Extemporaneously Compounded Preparations Genito-Urinary System Hormone Preparations – Systemic excluding contraceptives Infections – Agents for Systemic Use Musculoskeletal System Nervous System Oncology and Immunosuppressants Respiratory System and Allergies Sensory Organ Special Foods Page Numbers 8 – 10 10 – 12 12 – 14 14 – 17 17 17 17 – 19 19 – 23 23 – 24 24 – 29 29 – 31 31 31 – 33 33

Information provided for each pharmaceutical For each pharmaceutical (as defined by chemical name, form and strength) we have provided the following information: · · · · the current ex-manufacturer subsidy per unit of measure as at 1 September 2007; number of subsidised or partially subsidised units sold in the community in the year ending 30 June 2007; estimated annual community market value at current subsidies; and comments specifically relating to the Tender of the line item and/or its current listing on the Pharmaceutical Schedule.

The figures for the number of units subsidised in community pharmacies are approximate and are based on the year ending June 2007. These figures are indicative only and sales are not guaranteed. PHARMAC makes no representation as to the level of sales or likely sales of any tender item. There are no figures available for hospital pharmaceuticals. We have estimated market value by multiplying the volume of units subsidised in the year ending 30 June 2007 by the relevant listed unit subsidy as at 1 September 2007.
