CONSULTATION ON TENDER OF CERTAIN PHARMACEUTICALS FOR
RESPONSES DUE BY 5PM,
7 NOVEMBER 2003
In accordance with PHARMAC’s objective of securing for eligible people in need of pharmaceuticals, the best health outcomes that are reasonably achievable from pharmaceutical treatment and from within the amount of funding provided, PHARMAC is consulting on tendering for supply of certain pharmaceuticals to DHB Hospitals. These pharmaceuticals are appended to this letter entitled Schedule One. We seek comments on the approach outlined in the following pages, in particular the following: • the proposed process and timetable; • the actual or potential clinical implications of awarding Hospital Supply Status (as defined in Section H of the Pharmaceutical Schedule) to the pharmaceuticals listed in Schedule One; and • what the appropriate DV Limit for each product would be where a 0% DV Limit is considered clinically unacceptable. This document including the appendix is available on the PHARMAC website: www.pharmac.govt.nz. Additional hard copies can also be obtained by contacting PHARMAC. You can call us toll free on 0800 66 00 50 between the hours of 9am and 4pm weekdays. Background Since 1997 PHARMAC has been using the strategy of tendering for sole subsidised supply of community pharmaceuticals for a fixed period of time. Tendering has proven to be an effective way to encourage competition among suppliers of off patent pharmaceuticals. In 2002, the first tender for DHB hospital supply was issued with similar success to that achieved in the community. As in 2002, it is proposed that the community tender and hospital tender processes be run in unison, however the product list for each sector may be different. Key Aspects of Awarding a Tender: • The tender winning brand would be the only brand DHB hospitals could purchase (excluding any allowance for alternate brands under the agreed DV Limits) for
R31-2-0 #75102
approximately 2 years with an opportunity to extend the tender for an additional 12 months. From this tender process the Hospital Supply Status period will conclude on 30 June 2006 or 30 June 2007 (if the tender is extended). • No other brand of the pharmaceutical would be listed (or purchased) on Section H of the Pharmaceutical Schedule during the Tender period except as allowed under any DV Limits.
The Process The tender process is run annually and is structured as follows: Event September 2003 Consultation on proposed community product list with suppliers, medical groups and interested parties. Opportunity for suppliers to submit proposals that, if accepted, could prevent tendering.
Date
October 2003 November 2003 Late December 2003 Early March 2004 From April 2004 From August 2004
Consultation on proposed hospital product list with suppliers, medical groups and interested parties. Meeting of Tender Medical Evaluation Subcommittee of PTAC. Issuing of the Invitation to Tender 2003-04. Receipt of tender bids from suppliers to PHARMAC. Board decisions on tender winners announced. Hospital Supply Status and DV Limits apply to hospital tenders. Subsidy reductions to tender prices and consequent reference pricing for community tenders. Delisting of non-tender winning brands for community tenders. End of Hospital Supply Status (unless the tender is extended for an additional 12 months). Tender winning suppliers would continue to supply for at least three subsequent months. End of Hospital Supply Status (if the tender is extended for an additional 12 months). End of sole supply period for all products where a community tender is awarded in 2003-04 Tender. Tender winning suppliers would continue to supply for at least three subsequent months.
From November 2004 30 June 2006
30 June 2007
Tenders for Hospital Supply Status The pharmaceuticals listed in Schedule One are all proposed for tendering for Hospital Supply Status to DHB hospitals only. Contractual obligations for suppliers A copy of the draft contractual requirements which would form the clauses of the contract with successful suppliers in the 2003/04 Tender will be available for consultation in November 2003 on the PHARMAC website – www.pharmac.govt.nz – or by phoning PHARMAC. You can call free on 0800 66 00 50 between the hours of 9am and 4pm weekdays.

SCHEDULE ONE: POSSIBLE PRODUCTS FOR TENDER FOR SOLE SUPPLY Choice of products selected Schedule One lists the products for which we are consulting on tendering for supply to DHB Hospitals. PHARMAC welcomes any comments you may have with regard to the inclusion of these products in a tender for sole subsidised supply arrangements. Proposed tender products are listed alphabetically by chemical, form and strength (together forming a line item). Products that are known by PHARMAC to be on patent will not be included in the final tender list. The product list has been amended to aid in feedback for individual products. We have included space for you to suggest suitable DV Limits where you believe a limit other than 0% is necessary; space is also provided to enable brief justification for your recommendation. Hand-written comments are acceptable and you are welcome to make a more detailed written submission on any aspect of the proposed tender process and product list should you wish to.
